EBA Regulatory, Digital & Trade Committee meeting

The EBA Regulatory, Digital & Trade Committee met on 3rd of February 2026 to discuss the provisions of the draft law on the protection of personal data processed for the purpose of preventing and combating crime, which was launched for repeated consultation by the Ministry of Justice.

The Co-Chair of the Committee, Mr. Sergiu Bozianu, presented the risks that may arise from the implementation of the provisions of the draft law if it is approved in its current form. One of the key concerns regarding the implementation of the provisions of the draft law is that there is no secondary national framework for amendment, which is necessary for the implementation of the provisions of the draft law.

It should be noted that the draft law transposes into national law the provisions of Directive (EU) 2016/680 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of the prevention, detection, investigating or prosecuting crimes or enforcing criminal penalties, and on the free movement of such data.

However, there are many provisions that have been transposed in a worrying manner into the national draft law.

These issues have been presented and discussed with the EBA business community, and as a result, the European Business Association will present the position paper with the proposals submitted by the business community to the Ministry of Justice.

The business community is interested in the approval of effective public policies that ensure transparent and secure procedures for the processing of personal data.
