Deregulation of labor relations and OSH, discussed within Working Group No. 4

EBA Moldova participated in the meeting of Working Group No. 4, dedicated to topics related to the deregulation of labor relations and occupational safety and health, organized in the context of the broad process of developing deregulation packages.

This exercise is part of the Government's efforts to increase the competitiveness of the economy of the Republic of Moldova, including by advancing the actions provided for in the Growth Plan, related to the Regulatory Mapping process and the simplification of the regulatory framework.

The discussions focused on identifying balanced solutions that would contribute to reducing the administrative burden on companies, while maintaining employee protection standards and ensuring alignment with international conventions and European Union legislation.

Several proposals with a direct impact on the business environment were presented and analyzed during the meeting, including:
- revising the employer's obligation to approve staff lists;
- the possibility of including a conflict of interest clause in the individual employment contract;
- expanding the situations in which a fixed-term individual employment contract can be concluded;
- granting the employer the possibility to unilaterally modify the individual employment contract under certain clearly defined conditions.

EBA Moldova was represented at the meeting by Mr. Eduard Gurin, Chairman of the EBA HR Committee and Associate of Vernon David Law Firm, and Ms. Diana Bognibov, HR Director of National Power Corp SRL.

We reiterate that, previously, Mr. Eduard Gurin, as an EBA expert, presented a set of proposals aimed at contributing to the improvement of the regulatory framework in the field of labor relations and to the creation of a more flexible, predictable and adapted environment to the realities of companies in the Republic of Moldova.

EBA Moldova will continue to actively contribute to the consultation process, promoting a constructive dialogue between the authorities and the business environment, so that the next deregulation packages meet both the objectives of administrative simplification and the commitments to align with European standards.
