EBA Moldova is helping to finalize the reform of annual leave
The European Business Association, as a member of the National Confederation of Employers of the Republic of Moldova (CNPM), participated in the meeting of the National Commission for Consultations and Collective Negotiations on June 29, 2026, during which the draft law on amending the annual leave regime and social guarantees was discussed.
During the discussions, EBA reiterated its support for the goal of modernizing the legal framework and ensuring effective rest for employees, while also emphasizing the need for the new regulations to be clear, predictable, and practicable for both employers and employees.
EBA highlighted the importance of clarifying and adjusting the following aspects:
- clarifying the concept of “two consecutive working weeks of uninterrupted leave,” including for employees who work shifts, have flexible schedules, or are subject to a summary system for recording working hours;
- the need for methodological rules regarding the calculation and tracking of leave for 12-hour shifts and continuous work;
- establishing a clear and uniform mechanism for converting historical leave balances from calendar days to working days;
- re-evaluating the impact of converting paternity leave from 15 calendar days to 15 working days;
- ensuring financial neutrality in the conversion of additional leave provided for by the Labor Code;
- relaxing the requirement to use basic leave first in order to grant additional leave for parents with children;
- clarifying the rules regarding the calculation of leave pay, the carryover, and the use of unused leave days.

EBA will continue to consolidate its members’ comments into a position paper, which will be submitted to the competent authorities with a view to finalizing a balanced, functional legal framework that is adapted to the realities of the labor market.
